Prayer in this petition is for grant of regular bail in F.I.R.
No.48 of 2024, dated 17.10.2024, registered at Police Station,
Sunni, Tehsil Sunni, District Shimla, H.P. for the commission of
offences punishable under Sections 3(1)(r) & 3(1)(s) of the
Scheduled Castes and Scheduled Tribes (Prevention of
Atrocities) Act, 1989 and Sections 351(2) of the Bharatiya Nyaya
Sanhita (BNS), 2023 against the petitioner.
In the aforesaid facts and attending circumstances, the
bail-petitioner has submitted that he is innocent and has been
falsely implicated in the case at hand. Besides the aforesaid, he
has further submitted that he would not misuse the bail, in case
the same is granted and will not induce the witnesses or tamper
with the prosecution evidence.
In view of the aforesaid facts and attending circumstances,
the bail petitioner, who is aged 38 years and is permanent
resident of Village and Post Office, Basantpur, Tehsil Sunni,
District Shimla, Himachal Pradesh, as such, his presence can be
secured in the trial and, therefore, no fruitful purpose would be
served by sending him in custody, at this stage. Final opinion can
be formed after perusal of the record and status report.
Therefore, it is ordered that till the next date of hearing, the
petitioner shall be released on bail in the aforementioned FIR on
his furnishing personal bond in the sum of Rs.25,000/- (Rupees
Twenty Five Thousand only) with one local surety in the like
amount to the satisfaction of the learned Registrar/Additional
Registrar (Judicial), subject to the following conditions:
(i). The petitioner is directed to join the investigation on
20.11.2024 at 11:30 am at Police Station, Sunni, District
Shimla, H.P. He will also join investigation, as and when
called for by the Investigating Officer in accordance with
law.
(ii). The petitioner shall not tamper with the evidence or
hamper the investigation in any manner whatsoever.
(iii). The petitioner shall not leave India without prior
permission of the Court.
(iv). The petitioner undertakes not to contact the
complainant, to threaten or browbeat her or to use any
pressure tactics in any manner whatsoever.
(v). The petitioner undertakes not to make any inducement,
threat or promise, directly or indirectly, to the
Investigating Officer or any person acquainted with the

Prayer in this petition is for grant of regular bail in F.I.R.
No.67 of 2024, dated 09.11.2024, registered at Police Station,
Renukaji, District Sirmour, H.P. for the commission of offences
punishable under Sections 3(1)(r) & 3(1)(s) of the Scheduled
Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989
against the petitioner.
In the aforesaid facts and attending circumstances, the
bail-petitioner has submitted that he is innocent and has been
falsely implicated in the case at hand. Besides the aforesaid, he
has further submitted that he would not misuse the bail, in case
the same is granted and will not induce the witnesses or tamper
with the prosecution evidence.
In view of the aforesaid facts and attending circumstances,
the bail petitioner, who is aged 25 years and is permanent
resident of Village Khood, Post Office, Jarog, Tehsil Renukaji,
District Sirmour, Himachal Pradesh, as such, his presence can be
secured in the trial and, therefore, no fruitful purpose would be
served by sending him in custody, at this stage. Final opinion can
be formed after perusal of the record and status report.
Therefore, it is ordered that till the next date of hearing, the
petitioner shall be released on bail in the aforementioned FIR on
his furnishing personal bond in the sum of Rs.25,000/- (Rupees
Twenty Five Thousand only) with one local surety in the like
amount to the satisfaction of the learned Registrar/Additional
Registrar (Judicial), subject to the following conditions:
(i). The petitioner is directed to join the investigation on
20.11.2024 at 11:30 am at Police Station, Renukaji, District
Sirmour, H.P. He will also join investigation, as and when

In the case at hand, present petitioner/applicant has been
evicted on the ground of re-building. The submission of the
learned counsel appearing on behalf of the petitioner is that the
petitioner is entitled to be re-inducted as tenant in the newly
constructed building in the same place and location. In this
respect, learned counsel for the petitioner has drawn attention of
this Court to the decision of the Apex Court passed in Special
Leave to Appeal (Civil) No.36864/2013, titled Roshan Lal
Bhardwaj vs. Ashok Sud and another. Relevant extract reads
as follows:-
“The grievance of the petitioner is with regard to
the last portion of the order wherein the High Court
observed that the tenant should be re-inducted in the
same place, location and area which is equivalent to the
area which was in occupation of the tenant before the
orders passed by the learned Rent Controller.
It is submitted by the learned counsel for the
petitioner that such observation amount to give a
particular place and location in the newly constructed
building which may not be feasible in view of the new
plan and construction.
We are not agreeable to the said submission
made by the learned counsel for the petitioner. According
to us the High Court has asked the petitioner to re-induct
the tenant in the same place and location which means in
the same building on the same place, equivalent to the
area which was occupied by the tenant earlier.
It is needless to say that rest of the provision of
law as innumerated in proviso to Section 14 (C) of the
Himachal Pradesh Rent Control Act is required to be
followed.”
Since the argument of the petitioner is limited to what has
been held authoritatively by the Apex Court, therefore, till the
next date of hearing, operation and execution of eviction order
dated 16.12.2022, passed by Rent Controller, Chamba, in Rent
Petition No.14 of 2013, titled Vikas Sudan vs. Ishwar Kumar, as
affirmed by learned Appellate Authority, Chamba vide order dated
04.10.2024, in Rent Appeal No.1 of 2023, shall remain stayed.

(hereinafter referred to as ‘the Trial Court’), in Criminal case
No.218-III/2017, titled Punjab National Bank vs. Pawan Kumar,
and affirmed by learned Sessions Judge, Kangra at
Dharamshala, District Kangra, H.P. in Criminal Appeal No.
5-D/X/2023, titled Pawan Kumar vs. Punjab National Bank,
decided on 05.07.2024. The Revision Petition filed raises
arguable points. Hence, the sentence in the case at hand, is
ordered to be suspended, subject to the petitioner depositing 50%
of the compensation amount, if not already deposited, before the
Trial Court within four weeks from today and also subject to his
furnishing a personal bond in the sum of Rs.25,000/- with one
surety in the like amount to the satisfaction of the learned trial
Court, undertaking therein that petitioner will attend this Court as
and when required and in case of dismissal of the revision

petition, he will immediately surrender before the learned Trial
Court to receive the sentence.
A copy of this order be sent to the learned Trial Court with
the direction that the report of compliance of this order be
submitted to this Court within a period of six weeks.

2022, titled State of Himachal Pradesh vs. Tek Chand. The
appellant has been sentenced to undergo rigorous imprisonment
fir a period of two years and to pay a fine of Rs.20,000/-. The
amount of fine is stated to have been deposited, receipts
whereof, have been placed on record.
The appeal stands admitted and hearing whereof is going
to take some time. Hence, the sentence in the case at hand, is
ordered to be suspended, subject to the appellant furnishing a
personal bond in the sum of Rs.50,000/- with one surety in the
like amount to the satisfaction of the learned trial Court,
undertaking therein that appellant will attend this Court as and
when required and in case of dismissal of the appeal, he will
immediately surrender before the learned trial Court to receive
the sentence.

Prayer in this petition is for grant of regular bail in F.I.R.
No.167/2024, dated 12.10.2024, registered at Police Station,
Majra, District Sirmour, H.P. for the commission of offences
punishable under Sections 126(2), 115(2), 3(5) of Bharatiya
Nyaya Sanhita, 2023 and Sections 3(1)(ZA)(C) of the Scheduled
Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989
against the petitioner.
In the aforesaid facts and attending circumstances, the
bail-petitioner has submitted that she is innocent and has been
falsely implicated in the case at hand. Besides the aforesaid, she
has further submitted that she would not misuse the bail, in case
the same is granted and will not induce the witnesses or tamper
with the prosecution evidence.

the bail petitioner, who is aged 34 years, is permanent resident of

attending the said proceedings by the present applicant as it is
not possible to travel from Hamirpur to Chamba and return to

Other than the aforesaid, two minor daughters out of the
wedlock of the parties are to be maintained by the present
applicant and the fact that the applicant financially is dependent
upon her parents, is prima facie sufficient to stay the proceedings.
In the aforesaid facts and attending circumstances of the
case, balance of convenience lies in favour of the present
applicant. Grave irreparable loss would be caused to the
applicant, which cannot be compensated in terms of money, if in
case further proceedings are not stayed.
In view of above, proceedings pending before learned

judgment and decree dated 29.08.2023, passed by learned

Learned counsel appearing on behalf of the respondents
submits that in terms of law laid down by the Apex Court in
Shyam Sunder Sharma vs. Pannalal Jaiswal and others, AIR
2005 SCC 226, the position that emerges is that an appeal filed
along with application for condonation of delay in filing the appeal,
when dismissed on refusal to condone the delay, is nevertheless
the decision in the appeal.
Hence, according to learned counsel for the petitioners, in
the case at hand, a regular second appeal ought to have been
preferred, rather than a petition under Article 227 of the
Constitution of India.

The applicants-petitioner has preferred the present petition
against the judgment of conviction and order of sentence dated
28.03.2024, passed by learned Additional Chief Judicial
Magistrate, Court No.1, Rohru, District Shimla, H.P. (hereinafter
referred to as ‘the trial Court’), in Criminal case No.460-3 of
2021/2020, titled Yogesh Sihta vs. Dinesh Sharma and another
and affirmed by learned Additional Sessions Judge, Rohru,
District Shimla, H.P. in Criminal Appeal No. 33 of 2024, titled
Dinesh Sharma and another vs. Yogesh Sihta, decided on
07.08.2024. The Revision Petition filed raises arguable points.
Hence, the sentence in the case at hand, is ordered to be
suspended, subject to the petitioner depositing 50% of the entire
compensation amount, if not already deposited, before the Trial
Court within four weeks from today and also subject to his
furnishing a personal bond in the sum of Rs.50,000/- with one
surety in the like amount to the satisfaction of the learned trial
Court, undertaking therein that petitioner will attend this Court as
and when required and in case of dismissal of the revision
petition, he will immediately surrender before the learned trial
Court to receive the sentence. A copy of this order be sent to the

learned trial Court with the direction that the report of compliance
of this order be submitted to this Court within a period of six
weeks.
