1. They are heard. Perused the case-diary.
2. This is the applicant’s first bail application filed under Section 483
of Bharatiya Nagrik Suraksha Sanhita, 2023/ Section 439 of Criminal
Procedure Code, 1973, as he / she is implicated in connection with Crime
No.RC0082024A006 of 2024 dated 28.11.204 registered at Police Station
CBI, Bhopal, District Indore (MP) for offence punishable under Section 7 of
Prevention of Corruption Act, 1988. The applicant is in custody since
28.11.2024.
3. The allegation against the applicant is that he was caught red
handed while accepting Rs.15,000/- from the complainant.
4. Senior counsel for the applicant has submitted that the applicant
had no power to block or unblock the G.S.T./I.T.C. account. It is also

submitted that the applicant’s wife is seriously ill, as she has undergone
various organ removal surgeries, on account of advance stage of cancer, the
documents regarding which, have also been filed on record.
5. Counsel appearing for the respondent/CBI, on the other hand, has
opposed the prayer, and it is submitted that looking to the seriousness of the
offence, where the applicant has been caught red handed, and the
investigation is still pending, no case for grant of bail is made out.
6. Heard. Having considered the rival submissions, perusal of the
case-diary, and taking into account the fact that the charge-sheet has not yet
been filed, this Court does not find it to be a fit case to grant bail to the
applicant, at this stage.
7. Accordingly, the application is hereby dismissed.
8. However, with liberty reserved to the applicant to renew the
prayer after the charge-sheet is filed.
