The present appellant has been convicted and sentenced by First
Additional Session Judge, District Jaora in Sessions Trial No.15/2024, vide
judgment dated 6/12/2024 under Section 304 (Part II) of the IPC for a period
of 2 years R.I. with fine of Rs.500/- and in default of payment of fine amount
with further additional one month R.I and under Section 201 of IPC for a
period of 6 months R.I with fine of Rs.500/- and in default of payment of
fine amount with additional one month R.I.
Learned counsel for the appellant submits that the conviction of the
appellant is for a period of 2 years and the same has already been suspended
by the trial Court itself upto 6/1/2025. Hence, it is submitted that the
sentence be suspended since the appeal is of the year 2024 and shall take a
long time for coming up for hearing.

The prayer is opposed by the learned counsel for the respondent/State.
On due consideration of the submission of the learned counsel for the
parties and looking to the short sentence imposed upon the appellant and the
fact that the appeal is likely to take time, the application I.A No.20419/2024
is hereby allowed. It is directed that on deposition of fine amount and also on
each of them furnishing personal bond of Rs.50,000/- (Rupees fifty thousand
Only) each with one solvent surety in the like amount to the satisfaction of
the trial Court for his appearance before this Court/Registry on 13/5/2025
and on all other subsequent dates, as may be fixed by the Registry in this
behalf, the execution of substantial jail sentence imposed on the appellants
shall remain suspended, till the final disposal of this appeal.
Accordingly, IA No. 20419/2024 stands disposed off finally.
